Do Not Sell or Share My Personal Information

OptivMD does not sell Protected Health Information ("PHI") or Personal Information for monetary consideration. We collect, use, and disclose PHI solely as permitted or required by the Health Insurance Portability and Accountability Act of 1996 ("HIPAA"), its implementing regulations, and other applicable healthcare privacy laws. We maintain administrative, technical, and physical safeguards designed to protect the confidentiality, integrity, and availability of PHI.

In connection with providing telehealth services, clinical consultations, prescription fulfillment, care coordination, payment processing, and related healthcare operations, OptivMD may disclose PHI to healthcare providers, pharmacies, laboratories, and vendors acting as Business Associates under HIPAA. Such disclosures are governed by written Business Associate Agreements ("BAAs") that contractually require the protection of PHI and restrict its use and disclosure to permitted healthcare purposes.

Website Technologies and Online Identifiers

Like many healthcare organizations, OptivMD uses cookies, pixels, and similar technologies to support website functionality, enhance user experience, maintain security, prevent fraud, and understand how our website is used. These technologies may collect limited non-medical information, such as IP addresses, device identifiers, browser information, or general interaction data.

OptivMD does not use tracking technologies to disclose PHI for advertising purposes, and we do not knowingly permit tracking technologies to collect information that identifies you as a patient, reveals your health conditions, or relates to your diagnosis or treatment. Where vendors support website analytics or functionality and may incidentally receive data, they do so as service providers or Business Associates, subject to contractual restrictions and HIPAA-compliant safeguards, consistent with guidance issued by the U.S. Department of Health and Human Services Office for Civil Rights ("OCR").

California Privacy Rights (CCPA / CPRA)

The California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA"), provides California residents with certain privacy rights, including the right to opt out of the "sale" or "sharing" of Personal Information. Under California law, some disclosures of limited online identifiers (such as IP addresses or device identifiers) to analytics or advertising partners may be considered a "sale" or "sharing," even when no money is exchanged and no PHI is involved.
